Terms & Conditions

Welcome to the Calgary Marketing Association (CMA). These Terms & Conditions (“Terms”) govern your membership, use of the CMA website (the “Website”), participation in CMA events, programs, and any other services provided by the CMA (collectively, the “Services”).

 

By accessing or using the Website, becoming a member, registering for an event, or otherwise utilizing any of the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Website or Services.

 

1. Membership

1.1 Eligibility and Application

Membership in the CMA is open to individuals and organizations involved in the marketing industry who meet the eligibility criteria established by the CMA Board of Directors. All applications for membership are subject to approval by the CMA.

 

1.2 Membership Categories and Fees

The CMA offers various membership categories (e.g., individual, corporate, student). Each category has specific eligibility requirements, benefits, and applicable fees. Membership fees are non-refundable and are subject to change at the discretion of the CMA Board of Directors, with reasonable notice provided to members.

 

1.3 Membership Term and Renewal

Membership is valid for a 12-month term from the date of approval, unless otherwise specified. Memberships may automatically renew annually unless written notice of cancellation is provided to the CMA at least thirty (30) days prior to the membership anniversary date.

 

1.4 Member Obligations

As a member, you agree to:

 

    • Comply with these Terms & Conditions, the CMA Code of Ethics & Standards (as may be updated from time to time), and all applicable laws and regulations.

    • Provide accurate, current, and complete information during the membership application process and keep your contact information updated.

    • Conduct yourself professionally and respectfully in all interactions with the CMA, its staff, other members, and event attendees.

    • Maintain the confidentiality of any proprietary or sensitive information accessed through your membership.

 

1.5 Membership Termination

The CMA reserves the right to suspend or terminate your membership at any time, without refund, if you violate these Terms, the CMA Code of Ethics & Standards, or engage in conduct detrimental to the CMA or its members.

 

2. Website Use

2.1 Content and Intellectual Property

All content on the Website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of the CMA or its content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or Services for any commercial purpose without express written consent of the CMA.

 

2.2 Permitted Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and make personal and non-commercial use of the Website and Services. This license does not include any resale or commercial use of the Website or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this Website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

 

2.3 User Contributions

If you post content on the Website (e.g., comments, blog posts) or our online communities, you grant the CMA a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify the CMA for all claims resulting from content you supply.

 

2.4 Prohibited Conduct

You agree not to:

 

    • Use the Website for any unlawful purpose or in any way that violates these Terms.

    • Engage in any activity that interferes with or disrupts the Website or the servers and networks connected to the Website.

    • Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website, whether through hacking, password mining, or any other means.

    • Post or transmit any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

    • Impersonate or attempt to impersonate the CMA, a CMA employee, another member, or any other person or entity.

 

3. Events and Programs

3.1 Registration and Payment

Registration for CMA events and programs requires payment of applicable fees. All registrations are subject to availability and confirmation by the CMA.

 

3.2 Cancellation and Refunds

Cancellation policies for events and programs will be specified at the time of registration. Generally speaking, there are no refunds for membership or paid events. The CMA reserves the right to cancel or reschedule events or programs due to unforeseen circumstances, in which case attendees will be notified and offered a refund or credit.

 

3.3 Code of Conduct at Events

Attendees at CMA events and programs are expected to adhere to a professional and respectful code of conduct. The CMA reserves the right to refuse admission to or remove any individual from an event who, in the CMA’s sole discretion, is disruptive or whose conduct violates these Terms or the CMA Code of Ethics & Standards.

 

3.4 Crowd Release / Notice of Photography & Video

Your entry and presence on the event premises constitutes your consent to be photographed, filmed, and/or otherwise recorded and to the release, publication, exhibition, or reproduction of any and all recorded media of your appearance, voice, and name for any purpose whatsoever in perpetuity in connection with the Calgary Marketing Association and its initiatives, including, by way of example only, use on websites, in social media, news and advertising. By entering the event premises, you waive and release any claims you may have related to the use of recorded media of you at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such recorded media. You understand that all photography, filming and/or recording will be done in reliance on this consent. If you do not agree to the foregoing, please do not enter the event premises.

 

4. Disclaimers and Limitation of Liability

4.1 Disclaimer of Warranties

The website and services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. The CMA does not warrant that the website will be uninterrupted, secure, or error-free, or that defects will be corrected.

 

4.2 Limitation of Liability

In no event shall the CMA, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the website or services; (ii) any conduct or content of any third party on the website or services; (iii) any content obtained from the website or services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

 

5. Privacy Policy

Your use of the Website and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.

 

6. Governing Law and Dispute Resolution

6.1 Governing Law

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.

 

6.2 Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Services shall be resolved through good faith negotiations between the parties. If a resolution cannot be reached, the parties agree to pursue mediation in Calgary, Alberta, prior to litigation.

 

7. General Provisions

7.1 Entire Agreement

These Terms, together with the Privacy Policy and CMA Code of Ethics & Standards, constitute the entire agreement between you and the CMA regarding your use of the Website and Services.

 

7.2 Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

 

7.3 Changes to Terms

The CMA reserves the right, at its sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes by posting the updated Terms on the Website or by other means. Your continued use of the Website or Services after any such changes constitutes your acceptance of the new Terms.
